MidMichigan Health Social Media User Terms
MidMichigan Health (“MidMichigan”) strives to foster engaging and informative discussion across social-media platforms including, but not limited to, Facebook, Twitter, Pinterest, YouTube, MidMichigan Blogs, and LinkedIn (collectively “Social Media Sites”). Fans, followers, subscribers, and those who “like” MidMichigan’s Social Media Sites are allowed to view and post content on those sites. By accessing, viewing, or posting any content on MidMichigan’s Social Media Sites, you agree to the following terms.
Code of Conduct and Prohibited Content
Comments and posts to any MidMichigan Social Media Site should be relevant to the content posted on that site.
Fans are encouraged to stay on topic and to respect others who interact with the Social Media Site. The following types of comments and posts are prohibited:
- Language or content that contains profanities, obscenities, or indecent or pornographic material
- Language or content that is abusive, harassing, threatening, or defamatory
- Illegal content or content that violates individual property, privacy, or publicity rights
- Personal attacks on an individual or group
- Discriminatory language or content including, but not limited to, discrimination based on race, age, ethnicity, religion, gender, physical or mental disability, sexual identity, gender identity, or socioeconomic status
- Any content that contains any product or service endorsements
- Any content that could be construed as political lobbying, solicitation, or contribution or any content endorsing or disparaging any political candidate, party, campaign, or political issue
Posts that reference any individual by name, including any MidMichigan staff member, advanced-practice provider, and physician, as part of a complaint, concern, or compliment will be handled on a case-by-case basis. Depending on the circumstances, at MidMichigan’s sole discretion, the post or comment may be removed.
Per MidMichigan policy, photography or video of patients or staff members uploaded to any Social Media Site is prohibited without the consent of each individual and, in the case of a staff member, that staff member’s manager. Posts including photos or videos depicting patients or staff members may be removed at MidMichigan’s sole discretion.
Rights & Responsibilities
MidMichigan regularly reviews all content on Social Media Sites to maintain a courteous and supportive environment and to ensure that issues or concerns are addressed in a timely manner.
MidMichigan reserves the right, in its sole discretion, to remove prohibited content from any Social Media Site and to prohibit, restrict, block, suspend, terminate, delete, or discontinue your access to any Social Media Site at any time, for any reason, and without notice. You understand and agree that MidMichigan may disclose your communications and activities on MidMichigan Social Media Sites for numerous reasons including, but not limited to, (1) responding to requests by governmental authorities, (2) responding to judicial orders, warrants, or subpoenas, and (3) to protect MidMichigan’s rights and the rights of other people using MidMichigan’s Social Media Sites. You agree that if MidMichigan shares any content you post on MidMichigan’s Social Media Sites, MidMichigan will have no liability to you.
MidMichigan is not responsible for the content posted by any non-MidMichigan employee on any MidMichigan Social Media Site, nor does any posted content or comment by a non-MidMichigan employee constitute MidMichigan’s endorsement.
You understand that you are responsible for the content you post. You also understand that MidMichigan is not responsible for any legal issues that arise out of your interactions with MidMichigan’s Social Media Sites. You shall defend, indemnify, and hold MidMichigan, its corporate affiliates, and their respective officers, directors, employees, contractors, agents, and successors and assigns harmless from and against, and shall promptly reimburse them for, any and all losses, claims, damages, settlements, costs, and liabilities of any nature whatsoever (including reasonable attorney fees) that arise out of, are the result of, are based upon, or are in any way connected with your interaction with any MidMichigan Social Media Site. By posting any content on any MidMichigan’s Social Media Site, you grant MidMichigan the irrevocable right to reproduce, distribute, publish, or display that content. You also grant MidMichigan the irrevocable right to create derivative works from your posted content or to edit or modify that content and use it for any MidMichigan purpose.
You agree that any claim or dispute relating to your interaction with MidMichigan’s Social Media Sites shall be construed in accordance with the laws of the State of Michigan without regard to its conflicts of laws principles, and you agree to be subject to the exclusive jurisdiction of the local courts located in Midland County, Michigan and the federal courts located in the Eastern District of Michigan.
Due to HIPAA privacy laws, MidMichigan is unable to discuss any individual’s identity, symptoms, conditions, treatment, caregivers, medication, diagnoses, etc., in any public forum. MidMichigan’s Social Media Sites are not the appropriate place to file a complaint or request medical advice. MidMichigan offers private channels for patients and family members to communicate with doctors and provide feedback. To protect patient privacy, and to offer you the meaningful dialogue that your comments deserve, MidMichigan reserves the right to remove HIPAA-protected information from its Social Media Sites and to redirect those communications to appropriate private channels.
Concerns & Complaints
While MidMichigan makes every effort to follow up with patients and families who post to our Social Media Sites regarding issues they may have, we strongly encourage patients and families to contact MidMichigan directly to address any issues. If you are dissatisfied with any aspect of your care or experience with our health system, we want to hear from you.
